It's negotiable and set by local custom. In most Florida counties the seller customarily pays for the owner's title policy and selects the closing agent; in a few counties, including Miami-Dade, Broward, Sarasota, and Collier, the buyer customarily pays and chooses the agent. Either way, it can be negotiated in the contract.
Florida sets title insurance premiums by law, so the rate is the same no matter which agent you use, based on the property's price. As a guide, it runs about $5.75 per $1,000 of value up to $100,000 and $5.00 per $1,000 above that. Our closing cost calculator gives you an instant estimate.
